Standard Terms & Conditions of Hire
1. Definitions
1.1 The “Client” means the person, organisation or company booking equipment, acts or entertainment from the Company.
1.2 The “Company” means JS Entertainments Limited.
1.3 “Dry Hire” means the hire of equipment for the Client to operate and supervise.
1.4 “Wet Hire” means the hire of equipment or entertainment provided with a Company representative to supervise its use.
2. Bookings
2.1 All equipment remains the property of the Company at all times.
2.2 A booking is confirmed once an order is placed verbally or in writing (including email). By placing an order, the Client confirms they have read, understood and agree to be bound by these Terms and Conditions.
2.3 The Company will use all reasonable endeavours to fulfil its obligations. However, where performance is prevented or delayed by circumstances beyond its control (including but not limited to traffic, weather, or access restrictions), liability shall be limited to a refund of monies paid or a pro rata reduction for delayed start times. No further compensation shall be payable.
3. Prices, Deposit & Payment
3.1 A minimum non-refundable deposit of 25% is required to secure all bookings.
3.2 The remaining balance must be paid in full and cleared no later than 7 days prior to the event date, unless agreed otherwise in writing.
3.3 Approved account customers must settle invoices within 30 days of the invoice date unless otherwise agreed in writing.
3.4 All quoted prices are subject to change prior to booking confirmation.
3.5 The Company reserves the right to charge interest on overdue accounts at 2% above the Bank of England base rate.
3.6 All prices are subject to VAT at the prevailing rate.
4. Cancellations
4.1 Cancellation charges apply as follows:
– Within 8 weeks of the event: 25% of total booking value
– Within 6 weeks of the event: 50% of total booking value
– Within 4 weeks of the event: 75% of total booking value
– Within 2 weeks of the event: 100% of total booking value
5. Equipment
5.1 The Company reserves the right to substitute equipment with items of similar type and value without prior notice where necessary.
5.2 All sizes and specifications quoted are approximate.
5.3 All equipment remains the property of the Company at all times.
5.4 The Company reserves the right to amend or alter product specifications without prior notice.
6. Site, Access & Conduct
6.1 Equipment will be installed in one agreed location and must not be moved once set up.
6.2 The Client must ensure suitable access, space, and conditions for delivery and setup. The Company reserves the right to refuse delivery if the site is deemed unsuitable or if access issues (including stairs, long distances, or obstructions) have not been disclosed. In such cases, no refund will be given and full hire charges remain payable.
6.3 The Client is responsible for ensuring appropriate supervision, security, and crowd control throughout the hire period.
6.4 The Company reserves the right to cease operation and remove equipment without refund if, in its reasonable opinion, safety is compromised due to behaviour, environment, or misuse.
7. Liability & Insurance
7.1 The Client is responsible for and shall indemnify the Company against any loss, theft, or damage to equipment during the hire period.
7.2 The Company accepts no liability for loss or damage to personal property or for injury arising from use of the equipment, except where caused by the Company’s negligence.
7.3 Nothing in these terms shall limit or exclude liability for death or personal injury caused by negligence.
7.4 Equipment supplied on a Dry Hire basis is not covered by the Company’s insurance. The Client is responsible for arranging appropriate insurance cover.
8. Custom Branding & Artwork
8.1 The Client must not apply or attach any branding, signage, stickers, or materials to Company equipment unless agreed in writing in advance.
8.2 Unauthorised branding will be removed and charged at £75 + VAT per hour, with a minimum charge of 2 hours.
8.3 Where the Company provides branding services, the Client must supply artwork in print-ready format, meeting all specified requirements.
8.4 The Client is solely responsible for checking all artwork, including spelling, grammar, layout, and content.
8.5 The Company does not proofread artwork and accepts no responsibility for errors once submitted or approved.
8.6 Any reprints or additional production required due to Client errors will be charged in full.
